Welcome to Eleevy LLC (“Company,” “we,” “our,” or “us”). By accessing or using our services at www.eleevy.com (the “Website”) or engaging with us in any capacity, you (“Client” or “you”) agree to be bound by these Terms of Service (“TOS”). Please read these terms carefully before using our services.

1. Services

Eleevy LLC provides professional digital marketing and automation services, including but not limited to:

• Funnel and website design.

• Email marketing campaigns.

• CRM setup and automation workflows.

• Copywriting and content creation related to marketing funnels.

• Automation, workflow integration, and system optimization.

All services are delivered digitally and may include ongoing support, consultation, and updates as agreed in the project scope.

2. Client Responsibilities

Clients are responsible for:

• Providing accurate, complete, and timely information needed to perform services.

• Maintaining access to relevant accounts and platforms.

• Reviewing deliverables and providing feedback in a timely manner.

• Ensuring legal ownership of content and materials provided for inclusion in funnels or systems.

Clients will have access to their systems, dashboards, and workflows. While clients retain ownership of their specific account content, Eleevy LLC retains ownership of proprietary templates, frameworks, tools, and methodologies.

3. Payment Terms

Payment Methods: All payments are processed via Stripe or PayPal.

• Billing Cycle: Services may be billed monthly, quarterly, or annually, depending on the agreement.

Late Payments: Late payments may incur a service hold or suspension until resolved.

One-Time Payments: Payments for single projects must be completed before work commences unless otherwise agreed.

Recurring Payments: Subscription services will renew automatically at the agreed billing interval unless terminated according to Section 10.

4. Refunds and Satisfaction Guarantee

Eleevy LLC is committed to providing high-quality services and working closely with clients to achieve satisfactory results. While we do not guarantee specific business outcomes or revenue, we ensure that every client receives professional service and support.

Work in Progress: If a client is not satisfied while a project is underway, Eleevy LLC will review the request and may issue a partial refund or credit on a case-by-case basis, depending on the stage of delivery and work completed.

Completed Work: For projects or services that have been fully delivered and accepted by the client, refunds are generally not issued. However, Eleevy LLC will provide reasonable support, adjustments, or optimizations to address concerns and ensure client satisfaction.

Pre-Commencement: Refunds may be issued in full if the service or project has not meaningfully commenced.

One-Time and Recurring Services: The same principles apply to both one-time projects and recurring subscription services, ensuring consistency and transparency.

Eleevy LLC evaluates all refund requests fairly and in good faith, following industry-standard agency practices, to maintain trust and compliance with payment processors.

5. Ownership and Intellectual Property

Client Content: Clients retain full ownership of content, data, and information uploaded or created within their accounts.

Agency Content: Eleevy LLC retains ownership of proprietary templates, workflows, frameworks, designs, and methodologies.

License: Clients are granted a limited, non-exclusive license to use Eleevy LLC intellectual property within their projects.

6. Liability Disclaimer

Eleevy LLC acts as a professional agency providing services according to best practices. While we aim to optimize conversions and performance, we do not guarantee specific revenue, sales, or business results. Clients acknowledge that results depend on multiple factors, including their industry, market conditions, and content implementation.

7. Communication and Notices

Clients and Eleevy LLC agree to communicate through:

• Email (primary)

• WhatsApp or other messaging apps

• Phone calls

• Official social media channels

• Platform notifications (e.g., GoHighLevel or project management tools)

All notices sent through these channels are considered received unless an alternative preferred method is communicated.

8. Termination of Services

Clients may terminate services at any time with notice. For recurring services:

• Clients will be notified of upcoming renewal dates with reminders (50 days, 7 days, 1 day, and same day).

• Services may be terminated by Eleevy LLC in case of non-payment or violation of these TOS.

Upon termination, clients retain access to completed work and ongoing deliverables according to the ownership terms in Section 5.

9. Third-Party Services

Eleevy LLC may use third-party services to provide and support our offerings, including but not limited to:

• Analytics & Tracking: Google Analytics

• Advertising & Retargeting: Meta (Facebook) Ads, Google Ads, TikTok Ads, LinkedIn Ads

• Payment Processing: Stripe, PayPal

• Email & Communication Platforms: GoHighLevel, Amazon SES, SendGrid

• Automation & Workflow Tools: n8n, Zapier

These third-party providers have separate privacy policies and terms that govern data usage.

10. Governing Law and Jurisdiction

These TOS are governed by the laws of the State of Wyoming, United States. Any disputes arising from these terms or services shall be resolved under Wyoming law and subject to the exclusive jurisdiction of courts in Wyoming.

11. Miscellaneous

These TOS constitute the entire agreement between Eleevy LLC and the client regarding the services provided.

If any provision is found invalid or unenforceable, the remainder shall remain in full force.

Eleevy LLC may modify these TOS at any time; updated versions will be posted on the website. Continued use of services constitutes acceptance of updated terms.
